DEFINITION

Massage by Habileny same as massagebyhabileny.com same as Habileny Sanchez. Provider(s) same as Professional Certified Licensed Massage Therapist. Client(s) same as costumer or person seeking professional massage services. Outcall(s) same as professional mobile massage services. Incall(s) same as professional massage services in the massage facility.

NOT A SUBSTITUTE FOR MEDICAL EXAMINATION

Massage should not be construed as the substitute for medical examination or treatment and clients should see a physician, chiropractor or other qualified medical specialist for any mental or physical ailment they are aware of. Clients should tell their provider all their known medical conditions BEFORE THEIR MASSAGE APPOINTMENT. Clients should also keep the provider updated as to any changes in their medical profile, and understand that there shall be no liability on the provider's part should they forget to do so.

THERAPEUTIC PURPOSES ONLY

The providers listed on MassagebyHabileny.com website perform professional massages for therapeutic purposes only. Massage by Habileny does not provide any erotic, nude, naked, sensual, sexual, bikini, topless, body to body, nor happy ending massage services. It is understood that any inappropriate behavior such as excessive drinking, drug use, illicit or sexually suggestive remarks, or advances made by the client will result in immediate termination of the session, and client will be liable for payment for the "full" scheduled appointment. After the dispute is evaluated by Massage by Habileny, and Massage by Habileny determines that the client was at fault, the provider has the right to use Massage by Habileny to process the client's credit card.

HOURS OF OPERATION

Massage Hours of Massage by Habileny depends on area, location, and availability, but generally 24 hours 7 days a week.

Massage by Habileny has an online directory for people seeking professional outcall massage therapy by certified professionals at a massage facility or at their home, office, hotel, spa, beauty salon, or special event. Massage by Habileny is not personally affiliated with the massage providers listed on this website nor are we personally familiar with each one of their services. Massage by Habileny do not support any illegal activities or practices and each provider is responsible for his or her own licensing, certifications and insurances, for whichever areas he or she provides these services, as required by law. Massage by Habileny does not fully investigate the individuals who have listed on this site nor does Massage by Habileny evaluate the quality of their services. While Massage by Habileny monitors the reviews of the various individuals listed on this site, the listing of such individuals does not constitute an endorsement by Massage by Habileny, of their competence, skill, honesty or character. It is up to the client (and members of his/her household or workgroup) using this website massagebyhabileny.com to do a full screening of the massage provider(s) on the phone before the appointment time. The client uses the services of any provider listed on this website at his/her own risk, and Massage by Habileny will not be liable for any injury or loss suffered by the client due to the negligence or deliberate misconduct, illegal or otherwise (including criminal conduct) of individuals listed on this website. By using massage service from Massage by Habileny, client agrees to only contact the provider about obtaining a therapeutic massage. If a client makes an appointment request through the website, he/she understands that there may not be a suitable provider in his/her area. Client also understands that if a message is left for a provider that a provider may not return the call or email. If Client is under the age of 18, an adult must be present somewhere in the same location at all times during the massage. Any client feedback or reviews of therapists, etc. that are submitted to Massage by Habileny by clients or potential clients via web forms or email may be used in publicity material such as website promotions, brochures, newsletters, or other publications. All financial transactions regarding massage appointments booked through the directory of Massage by Habileny are between the client and the provider.

CLIENT DISPUTES WITH PROVIDERS

Providers on massagebyhabileny.com reserve the right to refuse giving a massage to a client after speaking with them on the phone before the appointment (as long as they do not commit to the appointment). Providers can also refuse giving a massage after meeting the client in person before the massage is to begin.

APPOINTMENTS - REFUNDS

Massage by Habileny does not offer any refunds if the client was unhappy with the quality of the massage.

APPOINTMENTS - CANCELLATION

Massage by Habileny requires a 24 hour notice per provider for cancellation. Failure to give this notice will result in being charged the full amount of the appointment. For events that are longer than one day, the cancellation must occur at least 24 hours before the initial date of the ongoing event.

APPOINTMENTS - RESCHEDULING

The rescheduling of appointments is between the provider and the client. However, if the client does not give 12 hours notice prior to rescheduling, the provider does have the right (if he, she chooses) to charge the client for the full appointment.

APPOINTMENTS - LATENESS OR CLIENT NO SHOW

If the massage provider shows up at the location, and the client is not there within 15 minutes of the specified time, then the massage will not be performed, and Massage by Habileny will charge the client in FULL. MASSAGE PROVIDERS: There is no lateness grace period for incall massage. Mobile outcall massage providers have a 30 minute grace period on their arrival time. If they are late beyond 30 minutes, then client has the right to cancel or reschedule massage session. MASSAGE PROVIDER NO SHOW: If the massage provider(s) does not show up at all (or beyond 1 hour after the appointment time), client does not have to accept the massage, and there is no payment required. APPOINTMENTS - MASSAGE BY HABILENY DURATION / RATE

Client agrees to pay the agreed upon rate of the provider at the time the appointment was booked. A 60 minute massage time includes dressing and undressing, but it does not include travel time. The actual hands on time will be approximately 50 minutes. Outcall massage mobile appointments, clients should make sure they have a room that is cleared for the massage season before the provider arrives. All payments received from clients are strictly for Professional Therapeutic Massage Services only!

APPOINTMENTS - PARKING POLICY

All parking charges must be reimbursed to the provider or paid to Massage by Habileny.

APPOINTMENTS - PROVIDER / CLIENT MISCONDUCT

If reports come back from client that there was provider misconduct, Massage by Habileny has the right at its sole discretion to take provider's profile off the website. If reports come back from provider that there was client misconduct, Massage by Habileny has the right at its sole discretion to immediately terminate scheduled massage services and/or report client to law enforcement authorities. Some examples of misconduct include: unethical behavior, request for sexual acts and/or sexual services, soliciting of prostitution, use of illegal drugs and/or narcotics, any illegal activity. ALL SUSPECTS OF ANY ILLEGAL ACTIVITY WILL BE IMMEDIATELY REPORTED TO LAW ENFORCEMENT AUTHORITIES!

FINAL AGREEMENT

By using this site, client and his/her party are acknowledging that they are at least 18 years of age and understand the risks described above. Client understands that the arrangement he/she may make with a massage provider listed on massagebyhabileny.com is a private arrangement between him/herself (and his/her party) and the massage provider involved ONLY, and that Massage by Habileny cannot and will not be liable for any body (or property) injury or loss occasioned by the negligent or intentional conduct of any individual listed on this site. UNDER NO CIRCUMSTANCES SHALL MASSAGE BY HABILENY BE LIABLE FOR DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR EXEMPLARY DAMAGES, RESULTING FROM ANY ASPECT OF YOUR USE OF THE MASSAGE BY HABILENY SITE OR THE SERVICE, WHETHER THE DAMAGES ARISE FROM USE OR MISUSE OF THE MASSAGE BY HABILENY SITE OR THE SERVICE, FROM INABILITY TO USE THE MASSAGE BY HABILENY SITE OR THE SERVICE, OR THE INTERRUPTION, SUSPENSION, MODIFICATION, ALTERATION, OR TERMINATION OF THE MASSAGE BY HABILENY SITE OR THE SERVICE. SUCH LIMITATION SHALL ALSO APPLY WITH RESPECT TO DAMAGES INCURRED BY REASON OF OTHER SERVICES OR PRODUCTS RECEIVED THROUGH OR ADVERTISED IN CONNECTION WITH THE MASSAGE BY HABILENY SITE OR THE SERVICE OR ANY LINKS ON THE MASSAGE BY HABILENY SITE, AS WELL AS BY REASON OF ANY INFORMATION OR ADVICE RECEIVED THROUGH OR ADVERTISED IN CONNECTION WITH THE MASSAGE BY HABILENY SITE OR THE SERVICE OR ANY LINKS ON THE MASSAGE BY HABILENY SITE. THESE LIMITATIONS SHALL APPLY TO THE FULLEST EXTENT PERMITTED BY LAW. Clients agree to indemnify and hold Massage by Habileny, its officers, subsidiaries, affiliates, successors, assigns, directors, webmasters, officers, agents, service providers, suppliers and employees, harmless from any claim or demand, including reasonable attorney fees and court costs, made by any third party due to or arising out of Content clients submit, post or make available through the service, clients' use of the Service, clients' violation of the Terms of Services, clients' breach of any of the representations and warranties herein, or clients' violation of any rights of another. Client agrees to ALL of these terms of services, and client understands that they apply to all services performed by Massage by Habileny. Lastly, to have the best experience with Massage by Habileny, we encourage clients to turn all phone ringers off, put their pets in a separate room, and let others in their location know that they are receiving a massage in order to avoid interruptions.
